Welcome to Shifting Gears Towing and Transport ("Shifting Gears"). By accessing or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully.
1. Definitions
“Company,” “We,” “Us,” “Our” refers to Shifting Gears Towing and Transport, based in Ballarat, Victoria.
“Client,” “Customer,” “You” refers to any person or entity using our towing and transport services.
“Services” refers to towing, transport, roadside assistance, and any related services provided by Shifting Gears.
2. Scope of Services
Shifting Gears offers towing and transport services for vehicles, heavy machinery, and general equipment within Ballarat, Victoria, and beyond. Our services include, but are not limited to:
Towing of vehicles (four-wheeled and two-wheeled)
Transport of machinery and equipment
Roadside assistance
Emergency towing services
Long-distance transport
3. Service Availability
Shifting Gears provides 24/7 service availability. However, service times may vary depending on weather conditions, traffic, or other unforeseen circumstances. We will always aim to reach the location as soon as possible but cannot guarantee specific timeframes.
4. Quotations and Pricing
All quotes provided by Shifting Gears are estimates based on the information provided by the customer at the time of booking.
Final costs may vary depending on additional factors such as distance, time, location, and the condition of the vehicle.
Any changes to the job that incur additional costs (such as longer distances or heavier loads than initially specified) will be communicated to you before proceeding.
5. Payment Terms
Payment is required upon completion of the service unless otherwise arranged.
We accept cash, major credit cards, and bank transfers.
Late payments may incur additional fees.
If your vehicle is being towed or transported due to an accident or breakdown, we may request upfront payment prior to the service.
Shifting Gears reserves the right to retain your vehicle until full payment is received.
6. Cancellations and Refunds
Cancellations must be made at least 2 hours prior to the scheduled service time. If cancellation is made within 2 hours of the scheduled time, a cancellation fee may apply.
Refunds are not provided for completed services. In case of any dissatisfaction, please contact us, and we will work with you to resolve any issues.
7. Liability and Insurance
Shifting Gears carries full insurance coverage for any vehicles or machinery while in our care, custody, and control. However, we are not responsible for any pre-existing damage or defects on the vehicle being towed or transported.
It is the customer’s responsibility to disclose any existing damage or mechanical issues before the service begins.
We take every precaution to ensure safe towing and transport. However, we are not liable for any damage caused by unforeseen or uncontrollable circumstances, such as:
Acts of God (flood, earthquake, etc.)
Unpredictable road conditions
Third-party accidents
8. Customer Responsibilities
You must provide accurate and complete information regarding the vehicle or equipment to be towed or transported, including but not limited to:
Vehicle make, model, and condition
Weight and dimensions of the equipment
Pickup and drop-off locations
You must ensure that the vehicle or machinery is safely and legally accessible for towing or transport. Shifting Gears reserves the right to refuse service if it is deemed unsafe or illegal to access or tow the vehicle.
If your vehicle is equipped with special requirements (such as alarms or immobilizers), it is your responsibility to provide any necessary instructions.
9. Emergency Situations
In emergency towing situations (such as breakdowns or flats), Shifting Gears will provide the fastest and most efficient service possible. However, priority may be given to customers in immediate danger or need.
Shifting Gears reserves the right to adjust arrival times or service availability based on demand and safety considerations.
10. Damage Claims
If any damage occurs to your vehicle or property during towing or transport, you must report it immediately and in writing within 24 hours of the service. Failure to do so may result in the claim being denied.
Any claims for damage will be assessed by our insurance provider, and if found liable, we will arrange for repairs or compensation.
11. Third-Party Services
Shifting Gears may, at times, use third-party contractors for certain services (e.g., long-distance towing). These third parties will be bound by the same terms and conditions outlined here. However, Shifting Gears is not responsible for the performance or behavior of third-party contractors.
12. Privacy
We respect your privacy. Any personal information collected during the provision of our services is kept confidential and used solely for the purpose of service delivery and invoicing. Please refer to our Privacy Policy for further details.
13. Termination of Service
Shifting Gears reserves the right to terminate or refuse service at any time if the customer is found to be engaging in fraudulent, unsafe, or illegal activities, or if the situation presents an undue risk to our staff.
14. Amendments to Terms
Shifting Gears may modify these Terms and Conditions from time to time. Any changes will be posted on our website and will take effect immediately upon posting. It is your responsibility to review these Terms regularly to ensure your compliance.
15. Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes or claims arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts in Victoria.
